Vineyard of Cash Terms Of Service
YOU MUST BE ABLE TO READ ENGLISH
AND UNDERSTAND THESE TERMS
Failure to understand these Terms says to me that you cannot read english and therefore - you are already in violation.
By signing up and actively using the
Vineyard of Cash program you agree to all terms and conditions set forth in this agreement.
Vineyard of Cash may, at any time, choose to edit, add and/or delete portions of this agreement
and impose changes without prior notification of its affiliates. Affiliates will
be informed of any and all changes to this policy. If any modification is unacceptable to you, your only recourse is to terminate this agreement. Your continued participation in the
Vineyard of Cash program following our posting of a change in policy notice or new agreement on
our site will constitute binding acceptance to the change.
COUNTRY RESTRICTIONS:
***Due to the Foreign Assets Control Policy in the U.S.***
We will not accept members or payments from the following countries: Angola, Burma, Cote d'Ivoire, Cuba, Iran, Iraq, Liberia, Libya, North Korea, Sierra Leone, Sudan, Syria, Western Balkans (Bosnia & Herzegovina, Albania, Macedonia, Serbia (including Kosovo) and Zimbabwe.
RESPONSIBILITY OF AFFILIATES:
You must be 18 years of age or older to participate in this program. Our program
is open to both US and International affiliates and is void where prohibited by
local governing laws.
You agree to and must use your own name, home address and e-mail address in the sign-up process
and may not assume a false identity. You may not sign-up multiple times with different
e-mail addresses. Your computer must not be shared with another individual that
has an existing
Vineyard of Cash account.
You will use your e-mail address / password combination to access your account,
it is your responsibility to keep this information confidential, you may change
this information by logging into your account and following the "User Account
Info." link.
You are solely responsible for any and all use of your
Vineyard of Cash account including authorization by you to any third party individual who may use
your account.
Should any instances of fraud, system abuse, or any type of activity deemed to
be inappropriate or illegal by
Vineyard of Cash be detected it may result in member termination and possible legal action. Any
solicitation of advertisers for a confirmation e-mail for purposes of receiving
credit in your account will be grounds for immediate termination.
You must maintain your e-mail account that you used when signing up with
Vineyard of Cash. You agree to receive e-mail advertising from
Vineyard of Cash. limited to no more than (100) per day.
In the event your e-mail account on file becomes closed or blocked to messages
from
Vineyard of Cash, your account will be terminated. This especially applies to e-mail accounts
returned for being Full. Any member sending us gibberish will result in automatic
termination of account and forfeiture of ALL earnings to date of termination.
Auto-responses will also be deleted immediately.
ACTIVITY REQUIREMENTS:
**ADVERTISERS NEED YOUR CLICKS**
-- Free members must click a minimum of 50 clicks every 30 days (any combination of email, ptc..etc) and have $0.10 in personal earnings for each $1.00 in downline earnings in order to request payout.
-- All other members (including free upgraded members) must click a minimum of 150 clicks every 30 days (any combination of email, ptc..etc) and have $0.10 in personal earnings for each $1.00 in paid to promote, affiliate page, and downline earnings in order to request payout.
-- All members must remain active and click(any combination of email, ptc..etc)every 30 days. Accounts that fall into an inactive status will be terminated after 30 days unless members account is otherwise noted(vacation time set, etc.) NO EXCEPTIONS!
AFFILIATE PAGES:
-- Affiliate Pages are offered as an extra earning feature.
-- Members with Affiliate Pages must click 150 clicks every 30 days (any combination of email, ptc..etc) and have $0.10 in personal earnings for each $1.00 in paid to promote, affiliate page, and downline earnings in order to request payout.
-- Affiliate Pages CANNOT be promoted in AUTO SURF EXCHANGES OR AUTO-URL ROTATORS SUCH AS AUTO CLICK EXCHANGES!
If the url has clickxsurf, surfclickxfinal, clicksurf or anything remotely like this, it will be deducted from your account. If I have to do this too many times, your affiliate page will be suspended. Thanks for understanding.
-- Affiliate Pages CAN be promoted in ways that offer manual clicking such as banner ads, text links, email ads, ptc ads, manual click exchanges or any means that allows a timer with a click for action to follow.
-- Affiliate Pages are currently paying 15c/1000 (subject to change).
PAID TO PROMOTE:
-- The Special Paid To Promote is offered as an extra earning feature.
-- Members using Special Paid to Promote Pages must click 150 clicks every 30 days (any combination of email, ptc..etc) and have 5% in personal earnings for each $1.00 in paid to promote, affiliate page, and downline earnings in order to request payout.
-- Special Paid to Promote Pages CANNOT be promoted in AUTO SURF EXCHANGES OR AUTO-URL ROTATORS!
-- Special Paid to Promote Pages CAN be promoted in ways that offer manual clicking such as banner ads, text links, email ads, ptc ads, manual click exchanges or any means that allows a timer with a click for action to follow.
-- The Special Paid to Promote is currently paying 10c/1000 to members.
CHEATING:
Members who are caught cheating will have their account terminated and will forfeit their earnings.
Instances of cheating include the following:
*Clicking on 3 or more cheat links.
*Caught using automated software to access the site.
*Having multiple accounts. Examples: same IP address/Payment Account/Computer ID.
*Clicking on 20 or more incorrect turing numbers.
*Having incorrect info listed in user's account
*Having bad interests selected in their accounts
*Having the free upgrade and clicking less than 50 EMAIL links
*Continually submitting (more than 3) of a 'banned site' for advertising. This means you can't read & write English and your account MAY be suspended, deleted, or penalized.
*Continually submitting 'unacceptable advertising' will get your account deleted.
*Promoting the Special PTP without purchase of a license. This means you can't read & write English and your account MAY be suspended, deleted, or penalized.
***If you are caught cheating, your account at our site will be canceled. No exceptions.***
PAYMENTS:
Affiliates may earn by receiving paid-emails and visiting the advertiser websites
after they have entered their member ID in the area on the website provided by
Vineyard of Cash. Affiliates may earn by referring new affiliates to the
Vineyard of Cash
program. Affiliates will earn a percentage of advertising revenues collected by
Vineyard of Cash.
Vineyard of Cash
will pay affiliates when their balance reaches the minimum payout rate set by
Vineyard of Cash. Once the member has reached payout they may request payment. Payments will be made within 30 days or a reasonable time after.
Payouts are made via Paypal, and AlertPay or members can use earnings for advertisement.
***AlertPay payouts will be made according to available funds.
***Effective August 11, 2009***
Due to the large amount of bot users from China, members from China can use their earnings for ad redemption only.
***India members may only request payout through Alertpay or Redemption Only.(Paypal is not an option for India members)
***Effective February 9, 2010***
Payouts can only be requested once every 30 days. If payout is larger than $4.00 you may not receive payment in full depending on available funds.
*** Effective July 17, 2010***
PTR Owners
Any Program Owner currently behind on payments (maximum of 60 days) and/or not answering support inquiries from their members MUST NOT request payout from vineyardofcash.com. If a payout request is received their account will be suspended until such time as their site is in order. Previous Program Owners of sites that have closed down without paying out members in full (including reimbursement of unused Upgrades and/or Affiliate Pages) will not be welcome.
CONVERTING POINTS TO CASH:
At this time there is no actual plugin for converting points to cash so points will be converted manually.
MEMBERS WHO ARE FROM REDEMPTION ONLY COUNTRIES WILL NOT BE ABLE TO CONVERT THEIR POINTS TO CASH ***ONLY CHINA AT THIS TIME***. If points are requested to be converted to cash and you are from a redemption only country, you request will be rejected.
RELATIONSHIP OF THE PARTIES:
You and
Vineyard of Cash
are independent contractors, and nothing in this Agreement creates any partnership,
joint venture, agency, franchise, sales representative or employment relationship
between you and
Vineyard of Cash. You understand that you do not have authority to make or accept any offers or
make any representations on behalf of
Vineyard of Cash. You may not make any statement, whether on your site or otherwise, that would
contradict anything in this section. You are solely responsible for the reporting
and payment of any taxes for money earned while using the program.
LIMITATION OF LIABILITY:
Vineyard of Cash
will not be liable for lost profits, lost business opportunities, or any other
indirect, special, punitive, incidental or consequential damages arising out of
or related to this Agreement or
Vineyard of Cash
program, even if
Vineyard of Cash
has been advised of the possibility of such damages. Furthermore,
Vineyard of Cash
aggregate liability arising under this Agreement will not exceed the amount of
the total fees paid or payable to you under this Agreement. The provisions of
this Section survive termination or expiration of the Agreement.
SPAM:
You may not promote your referral links through unsolicited emailing (i.e. SPAMMING),
newsgroup postings, or any other method of mass communication. Failure to comply
will result in immediate termination of your affiliateship with
Vineyard of Cash
and may result in legal prosecution.
Vineyard of Cash
strictly enforces anti-Spamming laws. Spamming is a federal crime. Any member
caught Spamming will not only have their account terminated immediately and lose
any past, present and future earnings, but shall also be held liable for Spamming
as we shall cooperate with any authorities and investigations that may arise from
the Spamming incident.
Vineyard of Cash
may charge up to $5 per spam e-mail sent. Multiple sign-ups shall be grounds for
immediate termination of all involved accounts. Signing up multiple times from
the same computer also constitutes fraud.
Vineyard of Cash
will file charges for recovery of any earnings received from multiple sign-ups.
